Jun 18, 2008
No. 3D08-1018 (Fla. Dist. Ct. App. Jun. 18, 2008)

Opinion

No. 3D08-1018.

Opinion filed June 18, 2008.

A Case of Original Jurisdiction — Mandamus. Lower Tribunal Nos. 99-25569; 98-35768, 97-12164; 97-22313.

Ignacio Franco, in proper person.

Bill McCollum, Attorney General, and Richard Polin, Assistant Attorney General, for respondent.

Before SHEPHERD, CORTIÑAS, and SALTER, JJ.

We grant Ignacio Franco's petition for writ of mandamus to compel the trial court to rule on his motions for post conviction relief filed on February 22, 2006, August 8, 2006, and November 6, 2006.

As we are hopeful that the lower court will comply forthwith, we withhold issuance of the formal writ for thirty (30) days.

Not final until disposition of timely filed motion for rehearing.
