598 A.2d 369 (Conn. App. Ct. 1991)

Opinion

(9395) (9396)

Argued November 4, 1991

Decision released November 19, 1991

Appeal, in the first case, from the decision by the named defendant granting a zone change on certain real property owned by the defendant Louis J. D'Amato et al., and appeal, in the second case, from the decision by the named defendant approving an application for a special permit to construct condominiums on that property, brought to the Superior Court in the judicial district of Ansonia-Milford, where the cases were consolidated and tried to the court, Meadow, J.; judgments dismissing the appeals, from which, on the granting of certification, the plaintiffs filed separate appeals to this court. Affirmed.

Robert L. Julianelle, with whom, on the brief, were Fernando F. de Arango, and Patrick W. Frazier, for the appellants (plaintiffs).

James W. Walsh, for the appellees (defendant Louis J. D'Amato et al.).

Our review of the record and briefs, and the oral arguments presented convince us that the petition for certification was improvidently granted.
