This case was calendared for trial at the session of the Court to be conducted remotely, commencing Monday, January 31, 2022, for cases in which Birmingham, Alabama, is listed as the place of trial. By Order served November 16, 2021, the Court granted the parties' Motion for Continuance. This case was stricken from the Birmingham, Alabama, session of the Court, continued and the undersigned retained jurisdiction.
On December 7, 2021, respondent filed a Motion for Partial Summary Judgment, Declaration of William Carl Hankla in Support of Motion for Partial Summary Judgment, and a Memorandum in Support of Motion for Partial Summary Judgment.
Upon due consideration and for cause, it is
ORDERED that on or before on January 25, 2022, petitioner shall serve on respondent and file with the Court a response to respondent's Motion for Partial Summary Judgment filed on December 7, 2021.
Petitioner is reminded that the Court's Order issued November 16, 2021, still remains in force as it relates to a proposed pretrial scheduling order, setting forth their proposal for trial preparation, resolution, and trial, if necessary, or a joint or separate, report as to the current status of this case on or before January 6, 2022, to file with the Court.
