ORDER VACATING GRANT OF RELIEF TO PLAINTIFF


On this day came to be heard Defendant's Motion for Reconsideration of Order Granting Relief and Ordering Special Election and Brief in Support in the above entitled and numbered cause. After consideration of the information and argument provided to the Court, the Court finds that (1) Defendant's proposed appointment of a replacement trustee to represent the constituents of single-member district 4 was not a violation of the Agreed Order or the Voting Rights Act; and (2) that a special election to elect a trustee to fill this position is not required.

IT IS THEREFORE ORDERED that the Court's previous Order, signed on September 10, 2001, is vacated in its entirety and shall have no force and effect from this date forward.
