From the 54th District Court McLennan County, Texas
Trial Court No. 2015-102-C2
ORDER
Sean Jeffrey Foster was convicted of Burglary of a Habitation and sentenced to 30 years in prison. TEX. PENAL CODE ANN. § 30.02 (West 2011). Appointed counsel on appeal filed a motion to withdraw and an Anders brief in support of the motion to withdraw on May 25, 2017 and provided Foster with a copy of the record for his appeal. See Anders v. California, 386 U.S. 738, 87 S. Ct. 1396, 18 L. Ed. 2d 493 (1967). Foster's response to his counsel's Anders brief was due June 26, 2017.
Foster requests an extension of 60 days to file his response. His request is granted to the extent that Foster's response is due 28 days from the date of this order. This shortened timetable is because Foster's response need not be a formal brief, but only need be a response that directs the Court to the areas to which he thinks the Court needs to pay particular attention. Should Foster fail to timely file his response, the Court will proceed with its review without further notice.
