398 So. 2d 559 (La. Ct. App. 1980)

Opinion

No. 13103.

February 11, 1980.

APPEAL FROM NINETEENTH JUDICIAL DISTRICT COURT, PARISH OF EAST BATON ROUGE; LEWIS S. DOHERTY, III, JUDGE PRESIDING.

Joseph Vernon Foster, Jr., and Louis Joseph Ballard, in pro. per.

S. Dwayne Broussard, Asst. Atty. Gen., Baton Rouge, for defendant-appellee.

Before ELLIS, CHIASSON and PONDER, JJ.

Plaintiffs appealed the dismissal of their suit to enjoin the infliction of any disciplinary action for failure to show respect to penitentiary employees not given to them by those employees.

No briefs have been filed by the plaintiffs. We have received no communication negating the intention to abandon. No one was present on the date set for submission of the case. We therefore deem the appeal abandoned. Rule VII, Sec. 5 of the Uniform Rules, Courts of Appeal.

APPEAL DISMISSED.
