OMAR FORTANEL-LEON, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 194th Judicial District Court Dallas County, Texas
Trial Court Cause No. F14-31205-M

ORDER

The reporter's record was due January 6, 2017. On February 28, 2017, we ordered court reporter Belinda Baraka not to sit until the complete reporter's record was filed. Although eight volumes of reporter's record were filed March 13, 2017, several exhibits (interviews by police with appellant) were missing. By order dated March 21, 2017, we acknowledged receipt of the eight volumes but noted the exhibits that were missing; in light of the missing exhibits, we did not vacate our February 28 order. On April 27, 2017, the missing five exhibits were filed.

We VACATE those portions of our February 28 and March 31, 2017 orders that order Belinda Baraka not sit as a court reporter.

We DIRECT the Clerk to send copies of this order to the Honorable Ernest White, Presiding Judge, 194th Judicial District Court; to Belinda Baraka, official court reporter of the 194th Judicial District Court; to the Dallas County Auditor's Office; and to all counsel for all parties.

We ORDER appellant's brief due May 30, 2017.
