ORDER
Mark V. Holmes Judge.
This case was on the March 15, 2021 St. Paul, Minnesota trial calendar. We continued it because petitioners had a CPA who was willing to file a power of attorney to try to negotiate a settlement. All seemed to be going well with informal discovery until the Court got a status report stating that the exchange of information had slown and then stopped. We spoke to the parties on September 8, 2021 and learned that this was true, but largely because the Forsbergs have no more records to give (with the possible exception of some records supporting the payment of union dues). We encouraged the parties to reach a reasonable settlement, but with no discovery left to be done it is now time to put the case on a trial calendar if they are unable to do so. It is therefore
ORDERED that this case is added to the Court's remote trial calendar that will begin at 1:00 p.m. Eastern Time on October 25, 2021. It is also
ORDERED that the Clerk of the Court is directed to attach a copy of the Court's standing pretrial order for that October 25, 2021 trial session to a copy of this Order served on the parties. This Order is the official notice to the parties of this schedule. It is also
ORDERED that on or before September 22, 2021 petitioners shall deliver to respondent's counsel cases any remaining documents (including any evidence of Mr. Forsberg's payment of union dues) that he believes substantiate his claimed deductions for the tax year at issue. Any of these records that he does not deliver to the IRS by that date will not be allowed into evidence in any trial of this cases.
