ORDER OF DISMISSAL; DENYING MOTIONS FOR IMMEDIATE CONSIDERATION AND RELEASE


Charles Fordjour ("petitioner"), currently incarcerated in an Arizona prison, filed this petition for a writ of habeas corpus under 28 U.S.C. § 2241 in the District of Arizona. The petition challenges a detainer placed upon petitioner by the State of California in connection with a 1998 conviction in the Santa Clara County Superior Court. The District of Arizona transferred the petition to this court under 28 U.S.C. § 1404(a).

The claims petitioner raises in the instant petition were raised and dismissed on their merits, with prejudice, in an earlier petition filed by petitioner in this district. See Fordjour v. Stewart, 02-0075 MMC (PR), slip op. at 4-6 (N.D. Cal. Jul. 9, 2002). For the reasons stated in the order dismissing that petition, the Court finds petitioner's claims in the instant petition likewise are without merit.

Accordingly, the above-titled action is hereby DISMISSED. Petitioner's motions for immediate release are DENIED and his motion for immediate consideration of the petition is DENIED as moot.

This order terminates docket numbers 4 through 7. The Clerk shall close the file.

IT IS SO ORDERED.
