MARK GERALD FORD, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Adam B. Landy Special Trial Judge

On March 3, 2023, the parties filed a settlement stipulation and a proposed stipulated decision. In reviewing the filings, the Court determined that both documents contained errors.

This case was called from the calendar for the trial session of the Court on March 13, 2023, for cases where Phoenix, Arizona, was listed as the place of trial. There was no appearance by or on behalf of the petitioner. Counsel for respondent appeared and was heard. Counsel for respondent agreed that there may be errors on the proposed stipulated decision regarding the amount of any prospective overpayment and orally moved for a continuance. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's oral Motion for Continuance is granted and this case is continued. It is further

ORDERED that, on or before May 1, 2023, the parties shall electronically file a proposed stipulated decision or status report (preferably a joint report) to inform the Court of the then-present status of this case. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
