Respondent District No. 1, Pacific Coast District, Marine Engineers' Beneficial Association, AFL-CIO having moved to dismiss an Article 78 proceeding commenced in this Court pursuant to Labor Law § 220(8) (Motion No. 2023-03672), Now, upon reading and filing the papers with respect to the motion, including the stipulation of the parties, dated September 08, 2023, and the correspondence from counsel for respondent District No. 1, Pacific Coast District, Marine Engineers' Beneficial Association, AFL-CIO, also dated September 08, 2023 and filed under Case No. 2023-03846, and due deliberation having been had thereon, It is ordered that the motion to dismiss the petition (Motion No. 2023-03672) and the petition itself (Motion No. 2023-03972) are deemed withdrawn in accordance with the aforesaid stipulation and correspondence.
