ORDER DIRECTING PLAINTIFF TO SERVE COMPLAINT


This Civil Rights action has been referred to the undersigned Magistrate Judge pursuant to Title 28 U.S.C. § 636(b)(1)(B). Plaintiff was granted in forma pauperis status. (Dkt. #4). Plaintiff subsequently paid the filing fee, (Dkt. # 13).

Plaintiff has filed an amended complaint as Ordered by the Court. (Dkt. # 15). He has not provided service copies of the complaint or U.S. Marshals forms for service. The Court will not perform service without these documents. The plaintiff now has 120 days to effectuate proper service on the Defendants as required by Federal Rule Civil Procedure 4. Failure to serve the defendants in that time frame will result in this action being DISMISSED WITHOUT PREJUDICE.

The clerk is directed to send a copy of this order to plaintiff and to note this case on the calendar for May 28th, 2003.
