EKATERINA FOMICHEVA v. ALBINA S POPLAVSKY LIVING TRUST
LC No. 24-000062-AV; 24-000391-AV
ORDER
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction because an order of a circuit court upon appeal from a district court matter is not appealable by right, i.e., by the filing of a claim of appeal, in the Court of Appeals. MCR 7.203(A)(1)(a). The appeal of an order of the circuit court on appeal from the district court must come by application for leave to appeal under MCR 7.205. MCR 7.203(B)(2). Dismissal is without prejudice to the filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
