This case is calendared for trial at the Court's March 13, 2023, Detroit, Michigan trial session. On January 27, 2023, the Commissioner filed a Motion to Dismiss for Lack of Jurisdiction as to only Jordan Bates and the Court ordered the petitioners to file a response by February 17, 2023. Petitioners did not respond, however the Commissioner filed a status report on February 17, 2023, advising the Court that petitioner Jordan Bates does not object. Accordingly, it is

ORDERED that the Commissioner's Motion to Dismiss for Lack of Jurisdiction as to only Jordan Bates, filed January 27, 2023, is granted and the caption of this case is amended to read: Austin Follen, Petitioner v. Commissioner of Internal Revenue, Respondent.
