ORDER

David Gustafson Judge.

This case was set for trial at the New York City trial session of the Tax Court beginning March 28, 2022. On March 25, 2022, Commissioner filed with the Court a Motion to Dismiss for Failure to Properly Prosecute. When this case was called from the calendar on March 28, 2022, there was no appearance by or on behalf of petitioner, Thomas Paul Fo. The Commissioner appeared through counsel and was heard on the motion to dismiss. For cause more fully appearing in the transcript of the proceeding, it is

ORDERED that the judge signing this order retains jurisdiction. It is further

ORDERED that Petitioner shall file a response to the motion to dismiss no later than April 27, 2022.
