On December 6, 2023, we abated this appeal to the trial court and ordered the trial court to issue a written order that finds the date when appellant FMO Media, LLC or its attorney first either received notice or acquired actual knowledge that the default judgment was signed. See Tex. R. App. P. 4.2(c). We further ordered the trial court to cause a supplemental clerk's record containing its order to be filed in this court by January 5, 2024, which, to date, has not occurred.
On January 30, 2024, appellant and appellee Clarity Mortgage, LLC filed a joint motion to extend the abatement for sixty days, asserting they have reached a tentative settlement agreement. We GRANT the joint motion, and ORDER the parties to file, by March 5, 2024, a notification regarding the status of the settlement or a motion requesting an appropriate disposition of this appeal. See Tex. R. App. P. 42.1, 43.2; Caballero v. Heart of Tex. Pizza, L.L.C., 70 S.W.3d 180 (Tex. App.-San Antonio 2001, no pet.) (per curiam). The case remains abated to the trial court. All other appellate deadlines, including the deadline for the filing of the supplemental clerk's record, are SUSPENDED.
