NOTICE TO PLAINTIFF AND RECOMMENDATION PURSUANT TO PRETRIAL MANAGEMENT REFERRAL


United States District Judge Sam A. Lindsay referred this case to the United States Magistrate Judge for pretrial management. Plaintiff, who is proceeding pro Se, has failed to provide the Court and opposing counsel with sufficient information to provide input into the pretrial plan or scheduling order. Plaintiff filed this case pro se on April 22, 2002. She states that she cannot provide information pertaining to scheduling because she is still trying to obtain counsel.

This Court hereby notifies Plaintiff that if she fails to comply with Court orders, the case is subject to dismissal for failure to prosecute pursuant to FED. R. CIV. P. 41(b).

RECOMMENDATION

This Court recommends that the District Court accept Defendant's estimate that discovery should be completed in seven months, set this case for trial at the District Court's convenience, and return the case to the United States Magistrate Judge for further pretrial management in accordance with a scheduling order to be entered by the District Court.
