Florida Pritikin C. v. Turnberry I.C

District Court of Appeal of Florida, Third District
Apr 5, 2000
753 So. 2d 798 (Fla. Dist. Ct. App. 2000)

Opinion

Nos. 3D99-2976 3D99-2891.

Opinion filed April 5, 2000.

An Appeal from a non-final order from the Circuit Court for Dade County, Paul Siegel, Judge. LOWER TRIBUNAL NO. 99-13642

Buchanan Ingersoll, M. Leslie Smith and Jill A. Cook-Edwards, for appellant Turnberry Country Club.

Greenberg Traurig, Arthur J. England, Jr., Paul R. Lipton and Barbara Lagoa, for appellant Florida Pritkin Center, Inc.

Richman Greer Weil Brumbaugh Mirabito Christensen, Gerald F. Richman and Lawrence H. Kunin; Sanford N. Reinhard, for appellee.

Before JORGENSON, GODERICH, and RAMIREZ, JJ.

Because the Turnberry Isle Condominium Association's complaint properly alleged an action on behalf of all unit owners concerning matters of common interest, Fla. R. Civ. P. 1.221, we find that the trial court properly denied the defendants' motions to dismiss for lack of class standing.

Affirmed.
