Opinion
No. 55848.
July 18, 1979.
Barry Richard, of Roberts, Miller, Baggett, LaFace, Richard Wiser, Tallahassee, for petitioner.
C. Graham Carothers, Tallahassee, for the Florida Board of Bar Examiners.
The Petition for Waiver of Article IV, Section 21(b) of the Rules of the Supreme Court Relating to Admission to the Bar is hereby granted.
ADKINS, BOYD and ALDERMAN, JJ., concur.
OVERTON, J., concurs with an opinion.
ENGLAND, C.J., and SUNDBERG and HATCHETT, JJ., dissent.
Although I did not participate as a member of the panel in three recent decisions of this Court which granted waiver of article IV, section 21(b), of the Rules of the Supreme Court of Florida Relating to Admissions to the Bar, I believe I am bound by those decisions because of the similarity of the facts in this case. I am therefore voting to grant the petition for waiver of the rule.
