Opinion
Case No. SC04-1783.
September 8, 2005.
Lower Tribunal No. 2003-30,893(10A).
After reviewing the uncontested referee's report and the parties' response to this Court's order to show cause, the Court disapproves the language in paragraph IV (B)(7) of the referee's report and paragraph 2(H) of the conditional guilty plea for consent judgment. Those paragraphs shall now read "In the event of allegations that respondent has violated his probation, The Florida Bar shall file a petition in this Court pursuant to Rule Regulating the Florida Bar 3-5.1(c), by which the respondent may be punished for contempt or further sanctioned."
Otherwise, the Court approves the uncontested referee's report and reprimands respondent. Further, respondent is placed on probation for three (3) years under the terms and conditions set forth in the report. Respondent shall comply with all other terms and conditions in the report.
Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Mark Randall Teal in the amount of $1,299.67, for which sum let execution issue.
Not final until time expires to file motion for rehearing, and if filed, determined.
