The Stipulation as to Probable Cause and Guilty Plea and Consent to Immediate Five Year Disbarment are approved and respondent is disbarred. Respondent agreed to cease the practice of law as of the date he executed the stipulation, therefore this disbarment is effective, nunc pro tunc, April 29, 2010. Respondent shall fully comply with Rule Regulating the Florida Bar 3-5.1(g). Further, respondent shall accept no new business from the date this order is filed.

Respondent is further directed to comply with all other terms and conditions of the stipulation.

Respondent shall pay restitution in the amount of $329,554.60 to Karen Roscher, Personal Representative for the Estate of Werner Clauss, and in the amount of $125,000.00 to Charles Murawski under the terms and conditions set forth in the stipulation.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Joseph Paul Sindaco in the amount of $1,394.45, for which sum let execution issue.

NOT FINAL until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this disbarment.
