Opinion
No. SC09-2365.
December 29, 2010.
Lower Tribunal No(s). 2005-11,382(06E).
The uncontested report of the referee is approved and respondent is suspended from the practice of law until such time that she provides proof of a passing score on the MPRE Exam as required by this Court's order dated November 2, 2006. If Respondent provides proof of her passing score on the MPRE Exam to this Court on or before the 90th day from the effective date of her suspension, she will be automatically reinstated. If Respondent is unable to provide proof of her passing score to this Court within 90 days from the effective date of her suspension, her suspension will become a rehabilitative suspension and she shall then be required to demonstrate proof of rehabilitation and passage of the MPRE Exam. This suspension is effective thirty days from the date of this order so that respondent can close out her practice and protect the interests of existing clients. If respondent notifies this Court in writing that she is no longer practicing and does not need the thirty days to protect existing clients, this Court will enter an order making the suspension effective immediately. Respondent shall fully comply with Rule Regulating the Florida Bar 3-5.1(g). In addition, respondent shall accept no new business from the date this order is filed until she is reinstated.
Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Maria Teresa Rodriguez in the amount of $1,420.00, for which sum let execution issue.
Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this suspension.
