Opinion

Case No. SC02-1750.

November 23, 2004.

Lower Tribunal No. 2001-50,875(17J).

Respondent Arthur Nathaniel Razor has petitioned for review of the referee's report in this attorney discipline matter. Having considered the referee's report and the briefs filed by the parties, the Court approves the referee's report in full except to the extent the referee recommends that Razor's suspension commence December 1, 2003, and to the extent the referee recommends that Razor make restitution to Christine Densley within sixty (60) days of the referee's report.

Respondent Arthur Nathaniel Razor is hereby suspended from the practice of law for sixty (60) days. The suspension will be effective thirty (30) days from the filing of this order so that Razor can close out his practice and protect the interests of existing clients. If Razor notifies this Court in writing that he is no longer practicing and does not need the thirty days to protect existing clients, this Court will enter an order making the suspension effective immediately. Razor shall accept no new business from the date this opinion is filed until the suspension is completed. Upon reinstatement to the practice of law, Razor shall be placed on two (2) years probation subject to the conditions as set forth in the referee's report. Respondent shall make full restitution to Christine Densley by paying her $2,000 within sixty (60) days from the date of this order. Razor shall furnish proof of said payment to The Florida Bar's headquarters office immediately after payment is made, in the form of a copy of the check paid to Ms. Densley.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Arthur Nathaniel Razor in the amount of $2,628.97, for which sum let execution issue.

Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this suspension.

PARIENTE, C.J., and WELLS, ANSTEAD, LEWIS, QUINCE, CANTERO and BELL, JJ., concur.
