Lower Tribunal Nos. 20040027(01B), 20040028(01B), 20040029(01B), 20040067(01B), 20040068(01B), 20040069(01B), 20040123(01B).


The Florida Bar filed and served a Petition Against the Unlicensed Practice of Law against respondent. The Court issued its Order to Show Cause to respondent and respondent filed a response to said Order to Show Cause.

The Court has determined as a matter of law that respondent engaged in the unlicensed practice of law. Accordingly, The Florida Bar's Motion for Summary Judgment is granted and the respondent's Motion for Summary Judgment is denied. Further,

IT IS ORDERED that respondent, Juan F. Evans, is permanently enjoined and restrained from engaging in the acts complained of and from otherwise engaging in the practice of law in the State of Florida.

Respondent is assessed a $7,000 monetary penalty pursuant to Rule 107.1(d)(1) of the Rules Regulating the Florida Bar, which shall be paid to this Court within 60 days of this order.

The Florida Bar is to file an affidavit of costs to be assessed pursuant to Rule 10-7.1(d)(2) of the Rules Regulating the Florida Bar within 20 days. Respondent is to file any objection to any of the costs within 20 days after service of the affidavit by the Bar.

Not final until time expires to file motion for rehearing and, if filed, determined.
