DECISION & ORDER ON MOTION

Motion by the respondent to waive the filing fee on an appeal from an order of the Supreme Court, Kings County (IDV Part), dated November 14, 2011, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to waive the filing fee is denied as unnecessary; and it is further

ORDERED that the branch of the motion which is for the assignment of counsel is denied.
