DANIEL C. FLINT v. DOUGLAS D HAMPTON

LC No. 2021-191154-CZ

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction because it was not filed within 21 days of the final order, the March 20, 2023 summary disposition order which was entered into the trial court register of actions on March 21, 2023, and no motion for postjudgment relief was filed within 21 days of March 21, 2023. MCR 7.204(A)(1)(a). The claim of appeal was required to be filed by April 11, 2023, 21 days from March 21, 2023. The claim of appeal was not filed until April 12, 2023. Therefore, it is untimely. Dismissal is without prejudice to the filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
