PRESENT:

Petitioner-appellant having moved to vacate the dismissal of the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on July 16, 2018, and for an extension of time to perfect,

Now, upon reading and filing the affirmation of Tina M. Hawthorne, Esq., dated January 21, 2018, the notice of motion with proof of service thereof, and the affidavit of Robert R. Vario, Esq., sworn to January 28, 2019, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an order vacating the dismissal of the appeal is dismissed as unnecessary, and

It is further ORDERED that the motion insofar as it seeks an extension of time to perfect is granted, that the time to perfect the appeal is extended to March 25, 2019, and that, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
