This case was calendared for trial at the Court's November 4, 2024, Washington D.C., trial session. On September 5, 2024, respondent filed a Motion to Supplement the Record. On the same date, respondent filed a Motion for Summary Judgment. By Orders served September 12, 2024, the Court directed petitioners to file a response to each of respondent's motions. To date, no such filings have been received by the Court.
When this case was called from the calendar on November 4, 2024, petitioner Bruce Fletcher and counsel for respondent appeared and were heard. At that time, petitioners made an oral Motion for Continuance. Respondent did not object. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is
ORDERED that respondent's Motion to Supplement the Record, filed September 5, 2024, is granted, in that the parties shall execute and file with the Court, on or before December 13, 2024, a First Supplemental Stipulation of Facts that shall include Exhibit 18-R and Exhibit 19-R. It is further
ORDERED that respondent's Motion for Summary Judgment, filed September 5, 2024, is taken under advisement. It is further
ORDERED that petitioners' oral Motion for Continuance, made November 4, 2024, is granted, and this case is continued. It is further
ORDERED that the parties shall, on or before January 3, 2025, file a written report (joint or separate) advising as to the then present status of the case. It is further
ORDERED that jurisdiction of this case is retained by the undersigned.
