ORDER

Diana L. Leyden, Special Trial Judge

On August 14, 2023, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution. This case was called from the calendar for the Trial Session of the Court at Boston, Massachusetts on September 18, 2023. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. At the Court's request, the trial clerk contacted petitioner and spoke with petitioner about the recall. On September 19, 2023, the case was recalled, petitioner and counsel for respondent appeared and were heard. Respondent indicated that a basis for settlement was reached and requested additional time for computations. After due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that jurisdiction is retained by the undersigned. It is further

ORDERED that, on or before November 20, 2023, the parties shall submit stipulated decision documents, or file a joint status report informing the Court as to the then-present status of this case.
