538 So. 2d 984 (Fla. Dist. Ct. App. 1989)

Opinion

No. 88-0315.

March 1, 1989.

Appeal from the Circuit Court for Broward County; James M. Reasbeck, Judge.

John M. Camillo of Vernis Bowling, P.A., Fort Lauderdale, for appellant.

Cathy Jackson Lerman of Cathy Jackson Lerman, P.A., and Earle Lee Butler, P.A., Fort Lauderdale, for appellee.

REVERSED. We reverse the trial court's entry of summary final judgment on the issue of coverage and the appellee's entitlement to arbitration. The record demonstrates a material issue of fact as to the existence of uninsured motorist coverage.

ANSTEAD and WALDEN, JJ., and OWEN, WILLIAM C., Jr., (Retired), Associate Judge, concur.
