THE FLORIDA BAR, Petitioner(s) v. Mitchell Jay ZIDEL, Respondent(s).


Upon consideration of the report of the referee, the Court disapproves of the referee's recommended sanction of a sixty-day suspension. However, the Court orders that Respondent shall not be reinstated to the practice of law in Florida, until he pays restitution in full, with interest, as previously ordered. See Fla. Bar v. Zidel, SC07–2150 (Fla. Feb 22, 2010)(“Respondent shall pay restitution in the amount of $1,212.71 to Marie Garcia, and in the amount of $11,994.02 to Elizabeth Warren, under the terms and conditions set forth in the report.”)

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399–2300, for recovery of costs from Mitchell Jay Zidel in the amount of $1,935.60, for which sum let execution issue. POLSTON, C.J., and PARIENTE, LEWIS, QUINCE, CANADY, and PERRY, JJ ., concur.

LABARGA, J., did not participate.
