Opinion

After considering the report of referee and the briefs filed by the parties, the report of referee is approved and respondent is hereby disbarred. As respondent is currently suspended, this disbarment is effective, nunc pro tunc, June 21, 2013, the effective date of the emergency suspension. See Fla. Bar v. Rainey, SC13–881 (Fla. May 22, 2013). Respondent shall fully comply with Rule Regulating the Florida Bar 3–5.1(h).

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399–2300, for recovery of costs from James Herbert Rainey in the amount of $10,073.50, for which sum let execution issue.

The filing of a motion for rehearing shall not alter the effective date of this disbarment.
