THE FLORIDA BAR, Complainant(s) v. James Crenshaw KELLEY, Respondent(s).


The uncontested report of the referee is approved and respondent is disbarred. Respondent is currently suspended; therefore this disbarment is effective immediately. Respondent shall fully comply with Rule Regulating the Florida Bar 3–5.1(g).

Respondent shall pay restitution in the amount of $120,370.21 to Carmel Jimenez within five years from May 31, 2012, and no later than June 1, 2017.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399–2300, for recovery of costs from James Crenshaw Kelley in the amount of $4,822.85, for which sum let execution issue.

The filing of a motion for rehearing shall not alter the effective date of this disbarment.
