TARA FITZGERALD, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan Chief Judge.

On July 19, 2024, the parties filed a Proposed Stipulated Decision. However, the signature on the signature block for respondent's counsel, Michael Thomas Garrett, does not comply with Rule 23(a)(3) of the Tax Court Rules of Practice and Procedure, insofar as it bears the name of another attorney-Jeri L. Acromite-rather than Mr. Garrett. Moreover, attorney Jeri L. Acromite did not sign the Answer and has not otherwise entered an appearance in this case on behalf of respondent.

Upon due consideration and for cause, it is

ORDERED that the above-referenced Proposed Stipulated Decision is deemed stricken from the Court's record in this case. It is further

ORDERED that, on or before August 23, 2024, the parties shall file a revised proposed stipulated decision.
