ORDERED that Defendants' Motion to Dismiss [Dkt. # 22] is GRANTED as to Counts I, II, V, VII, and VIII; it is further;

ORDERED that Defendants' Motion to Dismiss [Dkt. # 22] is DENIED as to Counts III, IV, and VI.

SO ORDERED.
