MEMORANDUM AND ORDER
For reasons which are not apparent from the face of the record, counsel for both sides habitually fail to respond to the other sides' motions. Local Rule 7.1 Motion Practice provides in (c) as follows:
Unless the parties have agreed upon a different schedule and such agreement is approved under Local Civil Rule 7.4 and is set forth in the motion, or unless the Court directs otherwise, any party opposing the motion shall serve a brief in opposition, together with such answer or other response which may be appropriate, within fourteen (14) days after service of the motion and supporting brief. In the absence of a timely response, the motion may be granted as uncontested. . . .
I am treating the motion to reconsider as being uncontested since defense counsel, despite having been served on April 1, 2003 with plaintiff's motion, has filed no response. An order follows:
AND NOW, this 28th day of April, 2003, upon consideration of the motion for reconsideration of this court's order dated March 26, 2003 denying plaintiff's motion to remand to the Court of Common Pleas of Philadelphia County the Civil Action filed by Miriam Fishman at case November Term, 2002, No. 1876, it is hereby ORDERED that the case styled Miriam Fishman, Plaintiff v. Monarch Life Insurance Company, Defendant, which has been removed to this court from the Court of Common Pleas of Philadelphia County, Pennsylvania, and bearing Docket No. 1876, November Term, 2002 on the docket of that court, be and same is hereby REMANDED to that court.
This court's order of March 26, 2003 vacating its order of February 25, 2003 is hereby VACATED.
This case is CLOSED.
