ORDER
We are in receipt of plaintiff's letter dated May 16, 2002 as well as defendant's letter in response dated May 19, 2002 and plaintiff's letter in response to defendant's letter dated May 22, 2002. After considering these letters in conjunction with defendant's notice of motion to dismiss the complaint we order the following:
1. Plaintiff has ten days to perfect service of process.
2. Defendant shall submit a memorandum of law in support of its motion pursuant to Local Rule 7.1 on or before June 19, 2002.
3. Plaintiff has until July 3, 2002 to file an opposition to defendant's motion — such an opposition may include the argument that defendant's motion should be designated a summary judgment motion for which discovery need be conducted.
4. Defendant may submit papers in further support of its motion on or before July 12, 2002.
