In a negligence action to recover damages for personal injuries, in which the defendant Ideal Toy Corporation asserted a cross complaint against the defendant Caristo Construction Corp., the parties appeal as follows from a judgment of the Supreme Court, Nassau County, rendered November 3, 1960, after a jury trial: (1) the three defendants Cook, Ideal and Caristo, appeal from so much of said judgment as is in favor of plaintiff and against them; and (2) the defendant Caristo also appeals from so much of said judgment as directs that defendant Ideal have judgment over against it (Caristo) for any sums which it pays to plaintiff pursuant to the judgment. Judgment affirmed, with one bill of costs payable to plaintiff by defendants Winfred Cook, Caristo Construction Corp., and Ideal Toy Corporation; and with costs payable to defendant Ideal Toy Corporation by defendant Caristo Construction Corp. No opinion. Nolan, P.J., Beldock, Ughetta, Christ and Pette, JJ., concur.
