RICHARD FISCHIO & LORRAINE FISCHIO, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan, Chief Judge

On August 22, 2023, the parties filed a Proposed Stipulated Decision and Settlement Stipulation. However, upon review of these filings, the Court notes that the Statement of Account (Form 3623) referenced as having been attached to the Settlement Stipulation has instead been attached to, and therefore filed with, the Proposed Stipulated Decision. Consequently, the Court is unable to process the Proposed Stipulated Decision as currently filed. That being so, it is

ORDERED that the parties' Proposed Stipulated Decision and Settlement Stipulation are hereby deemed stricken from the Court's record in this case. It is further

ORDERED that, on or before September 22, 2023, the parties shall file a proposed stipulated decision and, as a separate filing, a settlement stipulation, for the Court's consideration. The parties shall attach to the settlement stipulation the Statement of Account (Form 3623) referenced therein.
