Fischer v. Johnson

Appellate Division of the Supreme Court of New York, Second Department
May 29, 1967
28 A.D.2d 568 (N.Y. App. Div. 1967)

Opinion

May 29, 1967

Order of the Supreme Court, Kings County, dated October 25, 1966, modified by adding a provision thereto that the denial of plaintiffs' motion is without prejudice to renewal of such motion upon a more adequate showing of the cosmetic impact of the scar. As so modified, order affirmed, without costs. In our opinion, plaintiffs should have been granted leave to renew their motion upon a more adequate showing of the cosmetic impact of the scar. Christ, Acting P.J., Rabin, Hopkins, Benjamin and Munder, JJ., concur.
