We reverse the final order of dismissal upon the authority of Fidelity Federal Savings and Loan Association v. de la Cuesta, ___ U.S. ___, 102 S.Ct. 3014, 73 L.Ed.2d 664 (1982).

Accordingly, we reverse and remand for further proceedings consistent with de la Cuesta.
