The judgment is vacated. An order is to enter remanding the case to the Civil Service Commission with instructions that the commission, with reasonable promptness and after notice to all parties and at least summary hearing, shall certify to the Superior Court Department whether and to what extent the order of the commission dated May 14, 1971, remains in effect and is proposed for future enforcement. If the certificate of the commission states that that order is no longer in effect and has been superseded by the agreement, stipulation or order dated October 2, 1981, or by other action, order or decision of the commission, this action shall be dismissed. Otherwise the matter shall be dealt with further by the Superior Court Department upon the present record as supplemented by the certificate of the commission and by any further order or decision on which its certificate might be based. The clerk of this court shall preserve the present record and briefs until further order of this court.
