MEMORANDUM OPINION


On November 2, 2005, this Court notified appellant Michael Finneran that the time for filing his brief had expired. We directed appellant to file both a brief and extension motion within ten days and warned that his failure to do so would result in the appeal being dismissed.

As of today's date, appellant has not filed a motion or brief nor has he otherwise communicated with this Court regarding this appeal. Under these circumstances, we DISMISS the appeal. See Tex.R.App.P. 38.8(a)(1); 42.3(b), (c).
