APPEAL ERROR — MOTION FOR RULE ON THE CLERK — GOOD CAUSE FOR GRANTING. — An admission by an attorney for a criminal defendant that the record was tendered late due to a mistake on his part is good cause to grant a Motion for Rule on the Clerk.

In response to the Court's per curiam order of November 21, 1983, in this case, the petitioner's attorney, Jeff Rosenzweig, admits that if the Court adheres to its position expressed in that order, he was at fault in not filing the record in this case within the time allowed. The Court adheres to its position; so the record will be filed on the basis of counsel's admission of fault.
