Although appellant has requested the reporter's record in this appeal and is entitled to proceed without payment of costs, the record has not been filed. By postcard dated January 30, 2024, we notified Official Court Reporter Janet E. Wright that the record was overdue and directed her to file it within thirty days. When the record had not been filed by April 3, 2024, we ordered Ms. Wright to file the record no later than April 22, 2024. To date, however, the record has not been filed.
This appeal cannot proceed until the issue of the reporter's record is resolved. Accordingly, we ORDER Ms. Wright to file the record no later than May 21, 2024. We expressly caution Ms. Wright that failure to comply with this order may result in an order that she not sit as a court reporter until she complies.
We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Sally Montgomery, Presiding Judge of County Court at Law No. 3; Ms. Wright; and the parties.
