No. 05-07-01606-CV (Tex. App. May. 2, 2008)

Opinion

No. 05-07-01606-CV

Opinion issued May 2, 2008.

On Appeal from the 192nd Judicial District Court, Dallas County, Texas, Trial Court Cause No. 06-10049.

Before Justices MORRIS, WHITTINGTON, and O'NEILL.

MEMORANDUM OPINION

By order dated February 25, 2008, we granted the motion of appellant's counsel to withdraw. We ordered appellant to notify the Court, within fifteen days, of the name, address, and Texas State Bar number of new counsel. We further ordered appellant to file its brief within thirty days. When we did not receive the information regarding counsel or appellant's brief by April 2, 2008, we sent appellant a letter directing it to notify us of the name of counsel and to file a motion to extend time to file its brief within ten days or we would dismiss the appeal. To date, we have had no correspondence from appellant regarding either counsel or its brief.

Appellant is a corporation and may only appear through counsel. See Kunstoplast of Am., Inc. v. Formosa Plastics Corp., 937 S.W.2d 455, 456 (Tex. 1996) (per curiam). Because appellant has not provided information regarding counsel and has not filed a brief, we dismiss the appeal. See Tex. R. App. P. 38.8(a)(1), 42.3(c).
