The portion of paragraph one of the judgment dismissing Fil-Tek's contract claim against Balco is reversed, and that claim is to stand for further proceedings in the Superior Court consistent with the memorandum and order on file. The portion of paragraph one of the judgment dismissing Fil-Tek's G.L.c. 93A claim against Balco is affirmed. Paragraphs 2, 3, and 4 of the judgment are affirmed. Fil-Tek's motion for sanctions against Balco is to stand for further proceedings consistent with the memorandum and order on file.
