Fiketi v. South Beach Carousel Company

Appellate Division of the Supreme Court of New York, Second Department
Feb 1, 1926
216 App. Div. 725 (N.Y. App. Div. 1926)

Opinion

February, 1926.

Present — Kelly, P.J., Rich, Jaycox, Kapper and Lazansky, JJ.

Order setting aside verdict modified to the extent of directing that a new trial be granted; and as so modified unanimously affirmed, without costs. We think the evidence did not justify a holding that plaintiff was guilty of contributory negligence as matter of law.
