MEMORANDUM OPINION


On April 8, 2004, Marvin Douglas Figueroa filed a letter with the Court stating he had asked counsel to "cancel" this appeal and requesting information about the status of the appeal. To clarify appellant's intent to proceed with this appeal, the Court issued an April 14, 2004 order withdrawing the appeal from submission and ordering counsel to file, within twenty-one days, either a motion to withdraw the appeal or a letter stating appellant's desire to proceed with the appeal. On April 19, 2004, in response to the Court's order, appellant filed a second letter restating his desire to cancel the appeal. We construe appellant's April 19, 2004 letter as a motion to withdraw this appeal. Counsel has not filed anything in response to the Court's order. The Court GRANTS the motion of Adam L. Seidel to withdraw as counsel and DIRECTS the Clerk to remove Mr. Seidel as appellant's appointed attorney of record. The Court GRANTS appellant's motion to withdraw and ORDERS the appeal DISMISSED and that this decision be certified below for observance. See Tex.R.App.P. 42.2(a).
