BY ORDER OF THE COURT.

Appellee's motion to dismiss is granted, and this appeal is dismissed as untimely filed. This dismissal is without prejudice for the appellant to ask the appellee to vacate and reenter the order on appeal, from which the appellant may either appeal the reentered order or appeal the appellee's refusal to reenter the order. See Etienne v. Simco Recycling Corp., 721 So.2d 399 (Fla. 3d DCA 1998).

Appellant's motion for extension of time to file record and initial brief is denied as moot.
